The county of Essex in England continues to try to identify those who are illegally dumping asbestos-containing materials. Last weekend a 100-ton pile of asbestos, human waste and rubble was dumped in a local park in Essex, marking the third large-scale illegal dumping, or fly tipping as it’s also called, to stump authorities in the past month. In Spokane County, Wash., neighbors correctly responded to the dangerous situation by immediately notifying law enforcement about the leaking asbestos-filled bags; however, the bags have yet to be fully addressed since the emergency is “just” a “level three” call, according to county officials. Two more sentenced in illegal asbestos-dumping scheme in New York

DOJ logo 100x100 Two more sentenced in illegal asbestos dumping scheme in New YorkTwo more men who were involved in a scheme to illegally dump asbestos on wetlands in upstate have been sentenced and fined by the U.S. Attorney’s Office. Donald Torriero was sentenced to three years in prison and Julius DeSimone was sentenced to five years of probation. Additionally, the men were ordered to pay a fine of close to $500,000 in restitution.

In June, a federal court in Utica, N.Y., sentenced Mazza & Sons Inc. and its owner Dominick Mazza, along with property owner Cross Nicastro, with illegally dumping thousands of tons of asbestos-contaminated construction debris on wetlands property adjacent to the Mohawk River.

Mazza & Sons was a solid-waste disposal company. The scheme involved dumping construction and demolition debris from New Jersey using forged permits from the State Department of Environmental Conservation (DEC), as well as forging the name of a DEC official on the permits.

It is estimated about 400 truckloads of asbestos-contaminated waste was dumped on 28 acres of wetlands property before the scheme was discovered and stopped.

Charges included conspiracy to violate the Clean Water Act and Superfund Statute, and to defraud the United States.
